This Terms of Use applies to the app TryOnCam (referred to as "the App").

1. Acceptance of Terms and Explicit Consent

By downloading, installing, or using TryOnCam ("the App"), you:

• Explicitly agree to be bound by these Terms of Use
• Consent to the processing of your images as described in these terms
• Acknowledge that you have read and understood these terms
• Agree that your continued use constitutes ongoing acceptance of these terms

If you do not agree to these terms, please do not download, install, or use the App.

2. Description of Service

TryOnCam is a mobile application that uses artificial intelligence to generate virtual try-on visualizations by combining user-uploaded photos with clothing items. The App provides AI-generated outfit previews for visualization purposes only and is not intended to replace actual clothing purchases or professional styling advice.

3. Image Processing and Privacy

Important Privacy Notice:

• No Image Storage: We do not store, save, or retain any of your uploaded images on our servers
• Local Processing: All image processing is handled locally on your device
• Third-Party AI Services: Images are temporarily sent to Google Gemini AI for generation purposes only
• Automatic Deletion: Images are automatically deleted from third-party services after processing
• No Data Retention: We do not maintain any database of user images or generated content

4. User Consent and Responsibilities

By using this App, you explicitly consent to:

• Uploading your personal photos for local AI processing
• Temporary transmission of images to third-party AI services (Google Gemini) for generation
• Local processing and storage of generated results on your device only
• Use of the generated content at your own discretion

You are solely responsible for:

• All content you upload, including photos and clothing images
• Ensuring you have proper rights to use any uploaded content
• Your decisions based on generated try-on results
• Any consequences arising from your use of the App
• Compliance with all applicable laws and regulations

5. User Rights and Restrictions

You may:

• Use the App for personal visualization purposes to preview outfits on your photos
• Share your generated visualizations with others if you choose
• Use the App's built-in features for legitimate personal use

You may not:

• Modify, reverse engineer, or decompile the App
• Use the App for any illegal, harmful, or unauthorized purposes
• Upload photos that violate any laws, infringe on the rights of others, or depict illegal or inappropriate content
• Attempt to interfere with, exploit, or disrupt the operation or security of the App
• Use the App for commercial purposes without our prior written consent
• Upload copyrighted clothing designs, artwork, or intellectual property that you do not own or have permission to use
• Use the App to create misleading, deceptive, or fraudulent content
• Violate any applicable laws or regulations while using the App

6. Intellectual Property & Content Usage

Critical Notice: You are solely responsible for ensuring that any clothing designs, photos, or other content you upload or use in the App are either:

• Your own original creations
• Properly licensed for your use
• In the public domain
• Used with explicit written permission from the copyright holder

We do not claim ownership of your uploaded photos or content. Since we do not store your images, you retain full control and ownership of all your uploaded content.

7. Third-Party Services

The App uses Google Gemini AI services for image generation. By using the App, you acknowledge that:

• Your images may be temporarily processed by Google's AI services
• Google's terms of service and privacy policies may apply to this processing
• We are not responsible for Google's handling of your data
• You should review Google's privacy policy if you have concerns about their data practices

8. Generated Content & Disclaimers

The virtual try-on visualizations generated by the App are automated through AI services and intended solely for preview purposes. We make no claims about:

• The accuracy of how clothing will look in real life
• The fit, quality, or availability of any clothing items
• The suitability of any outfit for your body type or preferences
• The accuracy of colors, textures, or materials in the generated results

9. Professional Advice Disclaimer

Important: This App is for visualization purposes only. Before making any clothing purchases:

• Consult with professional stylists or fashion experts if needed
• Verify sizing, fit, and quality with actual retailers
• Consider your personal style preferences and body type
• Read actual product descriptions and reviews from retailers

10. Limitation of Liability & No Responsibility for User Actions

We are not responsible for:

• Any consequences resulting from the use of generated visualizations
• Copyright infringement claims arising from user-uploaded content
• Any issues with actual clothing purchases based on our visualizations
• Dissatisfaction with clothing purchases or styling decisions
• Any illegal or inappropriate use of the App by users
• User violations of these Terms of Use
• Third-party service interruptions or data handling by Google or other AI providers

To the fullest extent permitted by law, we are not liable for any damages arising out of your use or misuse of the App or its generated content. All use of the App is at your own risk.

11. User Misconduct and Violations

You acknowledge and agree that:

• Any illegal, harmful, or inappropriate use of the App is entirely your responsibility
• You will be held accountable for any violations of these Terms
• We reserve the right to terminate your access immediately for any violations
• You will not hold us responsible for any consequences of your misuse of the App

12. Copyright & Trademark Protection

• Description of the copyrighted work
• Location of the allegedly infringing material
• Your contact information
• Statement of good faith belief that use is not authorized

13. Privacy and Data Usage

Please refer to our Privacy Policy for details on how we collect and use data. Since we do not store your images, our data collection is minimal and focused on app functionality only.

14. Premium Features and Payments

Some features of the App may require a premium subscription. All payments are processed through the App Store. Refunds are subject to Apple's refund policy. We reserve the right to modify premium features and pricing at any time.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Updates will be reflected in the effective date, and continued use of the App constitutes your acceptance of any revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

17. Termination

We reserve the right to suspend or terminate your access to TryOnCam immediately, without prior notice, if you violate these Terms of Use or engage in any illegal or inappropriate behavior.
